Conditions of entry

Introduction

Huggies® Brand is proud to support the Huggies® Brand MumInspired® Grant Program (Program), through Kimberly-Clark Australia Pty Limited (Sponsor). It is important that you read and understand these Conditions of Entry so that you understand the processes and awards of the Program.

Terms

  1. Information on how to enter and awards forms part of these Conditions of Entry. Entry into the Program is deemed to be an acceptance of these Conditions of Entry.
  2. Entries into the Program must be received between 15 March 2011 at 10:00 AEST and 22:00 AEST on 1 May 2011 (Program Period).
  3. Entry is only open to Australian residents who are either pregnant or have a child aged up to 8 years old. Employees (and their immediate families) of the Sponsor, or agencies, suppliers or companies associated with this Program, are ineligible to enter.
  4. To enter, participants must:
    1. Join the Huggies Baby Club or Huggies Mum To Be Club (or log in if you are already a member);
    2. Go to the MumInspired® grant program page at www.huggies.com.au/muminspired (which may be accessed through huggies.com.au) for the Program application form (Form);
    3. Complete all details requested on the Form in accordance with the instructions on the Form. The entry must include a thoroughly considered business proposal, which nurtures the relationship between mother and child, and that is original and designed to help make life easier for parents with their little ones. The idea does not have to be nappy or hygiene related, but cannot have been brought to the market on any significant commercial scale (as determined by the Sponsor); and
    4. submit the completed Form in accordance with the directions on www.huggies.com.au/muminspired
  5. Limit of one entry and one award per person. Entries which do not include all details requested on the Form will not be considered.
  6. All valid entries received in the Program Period will be individually judged by a panel appointed by the Sponsor (which may include persons not employed by the Sponsor). The best five entries received will each win a $20,000 grant from the Sponsor (Main Award), conditional upon compliance with clause 8 below. If an entrant does not fulfil the requirements of clause 8 within a reasonable time period after being notified, the Sponsor reserves the right to withdraw the Main Award to that person and award it to the then next best entry.
    A summary of the entries of the final 5 winners of a Main Award will be put together by the Sponsor and displayed on www.huggies.com.au/muminspired and the Huggies® MumInspired® Facebook page. The summaries of the winners’ entries will then be placed in a ‘People’s Choice’ award, and the most popular entry, as voted by the public on Huggies® MumInspired® Facebook page, will win an additional $10,000 grant from the Sponsor (People’s Choice Award).
    Total award value in this Program is up to $110,000 (incl. GST). Each award will be paid by electronic transfer to the winner’s nominated account. Together, the ‘Main Award’ and ‘People’s Choice Award’ are referred to as ‘Award’ in the remainder of these Conditions of Entry.
  7. All entries will be judged having regard to the overall quality of the idea and proposal in the Form, including originality, relevancy, and potential commercial viability. This is a game of skill and chance plays no part in determining the winner. By entering the Program, you authorise the reproduction of your entry and Form (or parts thereof) (without attribution) and the editing or summary thereof prior to publication in whatever medium the Sponsor determines (including on www.huggies.com.au/muminspired or Huggies® MumInspired® Facebook page) without consultation. Winners also consent to reproduction of their name, signature, likeness, photographs, biography, and statements relating to their business and business idea without limitation;
  8. By entering, you acknowledge and agree that it is a condition of the Award that each winner of an Award will be required to sign an agreement with the Sponsor in a form to be determined in the absolute discretion of the Sponsor, which will include the following (amongst other matters):
    1. payment details of the Award;
    2. the winner must use the Award to set up a business incorporating the business proposal in the Form;
    3. the winner must report on progress of the business on a quarterly basis and on advances in their business enterprise;
    4. the winner, only if they consider selling their business, must offer the business to the Sponsor in the first instance;
    5. the winner will enable reproduction and public judging of a summary of their entry and Form (prepared by Sponsor) on the Huggies® MumInspired® Facebook page, consents to infringement of the winner’s moral rights for such reproduction, and the display will be subject to the terms of the Facebook site;
    6. the winner will permit the Sponsor to use worldwide the winners’ name, signature, likeness, photographs, biography and statements relating to their business and business idea without limitation; and
    7. the winner being required to be available for publicity purposes in connection with the Program for the total of at least a full day of each quarter during the year after award of the prize.
  9. The Sponsor’s and judges’ decisions are final, and no correspondence will be entered into, including in the event of a dispute. The winner will be notified by telephone. The Sponsor retains the right to substitute the Award with awards of equal or greater value.
  10. The Sponsor reserves the right to validate and check the authenticity of entries and to disqualify any entrant for tampering with the entry process. The Sponsor and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.
  11. If for any reason this Program is not capable of running as planned, the Sponsor reserves the right in its discretion to modify the terms of the Program including the awards and these Conditions of Entry.
  12. Each entrant warrants that their entry and Form, and ideas in their Form are original and do not infringe the intellectual property rights of any third party.
  13. Any tax liability arising as a result of accepting any award is the responsibility of the winner.
  14. The Sponsor will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of receiving, taking or using any award except for any liability which cannot be excluded by law.
  15. In the event that any award is won by a person under the age of 18, the award may be awarded to the winner’s parent or guardian.
  16. All copies of the entries become the property of the Sponsor. Any personal information provided will be used for the purposes of the Program. An entrant may access and correct any personal information held by the Sponsor, upon request to the Sponsor. All entrants agree that the granting of an award, the invitation to participate in the Program, the submission of a Form or entry, or any contact between Sponsor or its representatives and an entrant does not constitute an obligation on the part of either the Sponsor or entrant to enter into a commercial relationship, partnership or joint venture of any kind or a commitment to a further relationship with the other party beyond what is contemplated in these conditions.
  17. Each entrant acknowledges that the Sponsor or its related companies may currently or in the future be developing information internally, or receiving information from other parties, that is similar to the entrant’s confidential information. For example, the Sponsor and its related companies has a large research and marketing staff that is devoted to continually creating new products and improving the products it offers to consumers. It is not unusual for the Sponsor or its related companies to receive ideas that are similar to products or concepts that are already known to the Sponsor or under development somewhere within the Sponsor’s or its related companies research efforts around the world.
  18. Accordingly, nothing in these Conditions of Entry will be construed as a representation or agreement that the Sponsor will refrain from developing or authorizing another to develop any products, designs, concepts or product features that are similar to those contemplated in any discussions between Sponsor and an entrant or disclosed or embodied in the entrant’s entry/Form or other confidential information provided that the receiving party does not violate any of its obligations set forth in these Conditions of Entry or other subsequent agreement between the entrant and Sponsor.
