Promotion may only be entered in or from the Australian states (New South Wales, Victoria, Queensland, South Australia, Western Australia and Tasmania) and mainland territories (Canberra and the Northern Territory) and entries originating from any other jurisdiction are not eligible for entry.
1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into the Huggies The Baby & Toddler Show twitter competition (“Promotion”) is deemed to be an acceptance of these Conditions of Entry.
2. Promotion commences at 11:00 AEDT on 23 September 2010 and ends at 10:59 AEDT on 28 September 2010 (“Promotion Period”).
3. To be eligible entrants must:
a) During the Promotion Period, visit Promoter’s Twitter page at www.twitter.com/HuggiesAU (“Promoter’s Twitter Page”) or www.huggies.com.au/twittercompetition (“Promoter’s Site”) to receive instructions on how to enter the Promotion.
b) Register to be a ‘Follower’ of the Promoter’s Twitter Page at www.twitter.com/HuggiesAU
c) Tweet your response to the Huggies promotion question on the Promoter’s Twitter Page (“Promotion Question”).
d) To be eligible for a Daily Prize (as defined in paragraph 10), you must tweet your response to the Promotion Question with the hashtag “#HuggiesComp” on Twitter.
e) If you do not have a Twitter account, visit www.twitter.com to create one. Twitter accounts are free.
f) To be eligible for the Prize, you must un-check “protect my tweets” within your Twitter account settings prior to playing. Therefore all answers will be visible to the public.
4. One (1) Daily Winner of the Promotion will be selected for each day of the Promotion, as described in clause 8 (“Promotion Day”). The best response to the Promotion Question in an eligible entry, as judged by the Promoter, and as submitted by an entrant by including the hashtag “#HuggiesComp” on Twitter will be the winner. The judging of entries received for each Promotion Day will take place the working day after that Promotion Day has ended at or about 12:00 AEDT. Non-winning entries will not carry over to subsequent Promotion Days. Please note winners must claim their prize as set out in clause 13 below – or an alternative winner will be selected.
5. You may tweet answers to the Promotion Questions to gain as many entries as you like to the Promotion, but only the best entry for a Promotion Day will become a Daily Winner for that Promotion Day; if you become a winner you will not be qualified to enter the subsequent Promotion Days.
6. Participation is open only to legal residents of the six Australian states (New South Wales, Queensland, South Australia, Tasmania, Victoria and Western Australia) and the two mainland territories (Canberra and the Northern Territory). Employees, officers and directors of Kimberly-Clark Australia Pty Limited (“Promoter”), Red Ant Design Pty Ltd (“RAD”) and their parent companies, subsidiaries, affiliates, partners, suppliers, advertising and promotion agencies, manufacturers or distributors of promotion materials involved in the development, implementation and distribution of the Promotion or companies associated with the conduct of this Promotion and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees, officers and directors are ineligible to enter.
7. All valid entries received during the Promotion Period will be individually judged by a panel appointed by the Promoter at Red Ant Design Pty. Ltd (the “Judging Panel”). All valid entries will be judged having regard to the overall quality of the response to the Promotion Question, including literary composition, creative merit and originality. This is a game of skill, and chance plays no part in determining the winner. By entering the Promotion, you authorise the reproduction of your response to the Promotion Question (without attribution) on any publications and products the Promoter may choose and the editing of the response to the Promotion Question prior to publication without consultation.
8. All judging selection will be conducted by the Judging Panel at Red Ant Design Pty Ltd 162 Goulburn St Surry Hills NSW 2010 at or about 12:00 AEDT. Each of the following dot points constitute separate ‘Promotion Periods’:
- 11:00 AEDT on 23 September 2010 to 10:59 AEDT on 24 September 2010;
- 11:00 AEDT on 24 September and 10:59 AEDT on 25 September 2010;
- 11:00 AEDT on 27 September 2010 and 10:59 AEDT on 28 September 2010;
9. There will be a total of three (3) Winners throughout the Promotion Period.
10. The Daily Prize is for two (2) entrance pass valued at A$20.00 each pass to The Baby & Toddler Show at the Sydney Exhibition Centre in Darling Harbour, New South Wales held on 1st to 3rd October 2010. Total promotion period prize value is up to a maximum of A$120.00. The standard conditions of the entrance pass/ticket (as issued by the provider) apply to the pass/ticket.
11. The value of the prize is accurate at the date of commencement of the Promotion. The Promoter accepts no responsibility for any variation in the value of the prize after that date. The prize cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the prize with a prize of equal or greater value.
12. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
13. Potential Winners will receive a “Direct Message” from the Promoter through the Twitter account used to enter the Promotion approximately one (1) working day after the Judging in which the potential Winner’s entry was selected. Each potential Winner will be required to respond to the “Direct Message” and complete the Contact Form, defined below, within forty-eight (48) hours of receipt. Potential Daily Winners will be sent an email form (“Contact Form”) to provide their contact information including full name, email address, mailing address and/or contact to be awarded the Prize, which is required to validate eligibility or prize will be automatically forfeited. If the potential Winner does not respond to the “Direct Message” or complete the Contact Form within the required time frame the prize will be forfeited and awarded to the entrant with the next best answer.
14. Potential winners must continue to comply with all terms and conditions of these Conditions of Entry, and winning is contingent upon fulfilling all requirements.
15. If the winner cannot be contacted, or fails to complete and respond to the Direct Message within the required time period, if any prize or prize notification is returned as undeliverable, if any potential winner rejects his/her prize or in the event of noncompliance with these Promotion rules and requirements, such prize will be forfeited and may be awarded to the entrant with the next best answer or to another randomly selected eligible entrant in the Daily Prize. Upon prize forfeiture, no compensation will be given.
16. The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.
17. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute. The prize must be taken as offered and cannot be varied.
18. You must be an active holder of a non-private Twitter account to be eligible to enter this Promotion. All terms and conditions of twitter.com apply. Multiple entrants are not permitted to share the same Twitter account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different Twitter accounts, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any Twitter account, the authorised account holder of the email address used to register at twitter.com will be deemed to be the entrant. The “authorised account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organisation responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorised account holder.
19. Promoter will be collecting data about entrants through the Promoter’s Twitter Page and Promoter’s site, in accordance with its privacy policy available at the Promoter’s website at http://www.huggies.com.au/privacy.asp.
20. By participating in the Promotion, entrants hereby agree: (i) to Promoter’s collection and usage of their personal information and acknowledge that they have read and accepted Promoter’s privacy policy; (ii) that Promoter may send the entrant information and regular updates regarding the Promotion via the Twitter account used to enter the Promotion; (iii) that all claims and entries become the property of the Promoter; (iv) that the Promoter may publish the entrant’s name, Twitter account user name and any images associated with the Twitter account user name of the entrant, on the Promoter’s Site, the Promoter’s Twitter Page and to third parties as required by law (including authorities that regulate this Promotion).
21. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion.
22. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the promotion including the prizes and these Conditions of Entry.
23. Any tax liability arising as a result of accepting any prize is the responsibility of the winner.
24. The Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of receiving, taking or using any prize except for any liability which cannot be excluded by law.
25. Any attempted form of entry other than as set forth above is prohibited; no automatic, programmed; robotic, use of multiple mice, or similar means of entry are permitted. The Promoter, its affiliates, partners and promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorised human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Promotion, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Promotion or downloading any materials in this Promotion. The Promoter reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Promotion should (in its sole discretion) virus, bugs, non-authorised human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Promotion. In such case, the Promoter may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by the Promoter. The Promoter reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Promotion or web site. The Promoter may prohibit an entrant from participating in the Promotion or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or the Promoter representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
