1. Information on how to enter, mechanics of entering and Prizes form part of these Conditions of Entry. Entry into the “Win a 6 Month Supply of HUGGIES® Products” promotion (Promotion) is deemed acceptance of these Conditions of Entry.
2. The promoter is Kimberly-Clark Australia Pty Ltd, 52 Alfred Street, Milsons Point NSW 2061, ABN 65 000 032 333 (Promoter).
3. Entry is only open to Australian residents who are 18 years or older and are members of the HUGGIES® Baby Club or HUGGIES® Mum to Be Club (Entrants). Entrants who are not already HUGGIES® Baby Club or HUGGIES® Mum to Be Club members can join online at www.huggies.com.au.
4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. Entries open at 9:00am AEDST on 03/10/16 and close at 11:59pm AEDST on 13/11/16 (Promotion Period).
6. To enter the promotion, Entrants must complete the following steps during the Promotion Period (Entry):
a. purchase any two (2) Eligible Products in the one transaction (Eligible Purchase) and retain their store receipt as proof of purchase;
b. visit www.huggies.com.au/buy2win (Promotional Website) and login to their HUGGIES® Baby Club or the HUGGIES® Mum to Be Club account;
c. accurately enter all personal information into the online entry form for the Promotion;
d. accurately enter the last four (4) digits of the barcodes for the Eligible Products, and the name of the retailer and the State in which the Eligible Products were purchased; and
e. Clink on “Enter Promotion”.
7. For the purposes of this Promotion, eligible products means HUGGIES® Nappies, HUGGIES® Nappy-Pants, HUGGIES® Pull-Ups, HUGGIES® Little Swimmers, HUGGIES® Change Mats or HUGGIES® Wipes (Eligible Products).
8. For the purposes of this Promotion, Eligible Purchases do not include online purchases, or purchases at stores in Western Australia, Northern Territory, Tasmania, or the Australian Capital Territory.
9. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt. The Promoter and its associated agencies or companies accept no responsibility for any lost or misdirected Entries.
10. Incomplete, inaccurate or indecipherable Entries will be invalid.
11. Multiple Entries are permitted, subject to the following: (a) an Eligible Purchase permits one Entry to the Promotion; (b) each Entry must be a new Eligible Purchase, submitted separately and must independently comply with these Conditions of Entry.
12. Entrants must retain the original barcode(s) and store receipt(s) from Eligible Purchases which pertain to each Entry. Store receipt(s) must be intact, must clearly display details of the Eligible Products purchased and must indicate that the Eligible Purchase was made during the Purchase Period, but prior to entry.
13. Winners will be asked to provide the original barcode(s) and store receipt(s) for all Entries submitted by the Entrant. By way of example, if an Entrant enters the Promotion 5 times, and one of those Entries is drawn as a winner, the Entrant will be required to provide the original barcodes and receipts for all 5 entries to the Promoter. Failure to produce the required original barcode(s) and store receipt(s) for ALL entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL Entries submitted by the Entrant and forfeiture of any right to a Prize or offer.
14. The Promoter reserves the right, at any time, to verify the validity of the Entries and Entrants (including an Entrant’s identity, age, and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
15. If there is a dispute as to the identity of the Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
16. There will be four (4) draws conducted for this Promotion (Draws). Entries will be allocated to a Draw based on the State in which the Eligible Purchase was made:
a. Draw 1 will be made up of all Entries received with Eligible Purchases made at stores in South Australia during the Promotion Period (SA Entries);
b. Draw 2 will be made up of all Entries received with Eligible Purchases made at stores in Queensland during the Promotion Period (QLD Entries);
c. Draw 3 will be made up of all Entries received with Eligible Purchases made at stores in New South Wales during the Promotion Period (NSW Entries); and
d. Draw 4 will be made up of all Entries received with Eligible Purchases made at stores in Victoria during the Promotion Period (VIC Entries).
17. Winners will receive a 6 Month Supply of HUGGIES Products valued at up to $810.46 (Prize). There are 25 Prizes to be won with a total prize pool of up to $20,261.50. The value of the Prize is accurate at the date of commencement of the Promotion Period and based upon the recommended retail prices at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Prize after that date. Each Prize consists of:
a. 42 convenience size packs of HUGGIES® Nappies (in size and variety requested by the winner), valued at up to $600.00;
b. 8 pop up tubs of HUGGIES® Wipes (in variety requested by the winner), valued at up to $50.32;
c. 6 refill packs of HUGGIES® Wipes (in variety requested by the winner), valued at up to $35.94;
d. 12 packs of HUGGIES® Change Mats, valued at up to $47.88; and
e. 6 packs of HUGGIES® Little Swimmers Swim Pants (in size and variety requested by the winner), valued at up to $76.32.
18. The Prizes will be awarded follows:
a. Draw 1 (SA Entries) – The first ten (10) eligible Entries drawn electronically will win a Prize.
b. Draw 2 (QLD Entries) – The first five (5) eligible Entries drawn electronically will win a Prize.
c. Draw 3 (NSW Entries) – The first four (4) eligible Entry drawn electronically will win a Prize.
d. Draw 4 (VIC Entries) – The first six (6) eligible Entries drawn electronically will win a Prize.
19. The electronic draws to determine the winners will take place at 10:00am (AEDST) on 16/11/16 at Level 2, 608 Harris Street, Ultimo NSW 2007. The winners will be notified by telephone and in writing by 23/11/16. Valid winners’ names and locality will be published at www.huggies.com.au/buy2win by 30/11/16. All reasonable steps to notify the winner of the results of the Promotion will be taken by the Promoter.
20. The Promoter may draw ten (10) additional reserve entries from each draw and record them (in order) in case an invalid entry or ineligible Entrant is drawn or the Entrant is ineligible to accept the prize. In the event of an invalid entry or an ineligible Entrant, or if the Entrant is ineligible to accept the prize, the prize will be awarded to the first reserve entry drawn. If the prize cannot be awarded to the Entrant drawn, the Promoter will continue this process until the prize is awarded. If after this process the prize has still not been awarded, or if an Entrant drawn cannot be notified, the Promoter will hold an unclaimed prize draw in accordance with Condition 22.
21. Subject to the unclaimed prize draw, if for any reason, a winner does not take a Prize (or an element of a Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.
22. The Promoter may conduct a further draw for the prizes at the same place as the original draws as is necessary at 10:00am (AEDST) on 17/02/2017 in order to distribute any prizes unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of a winner in the unclaimed prize draw, the winner will be notified by telephone and in writing by 24/02/2017. Valid winner’s name and locality will be published at www.huggies.com.au/buy2win by 28/02/17. All reasonable steps to notify any winner of the results of the draw will be taken by the Promoter.
23. There is a limit of one (1) prize per HUGGIES® Baby Club or the HUGGIES® Mum to Be Club member/ household except in South Australia. Once an Entrant (other than an Entrant residing in South Australia) wins a Prize, that Entrant (and any other Entrant residing in the same household as that Entrant) will not be eligible for any further prizes in this promotion. For the purposes of this promotion, a ‘household’ is deemed to be the residential address stated in an Entrant’s Entry form.
24. The Prizes (including any unused portion of a Prize) are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). The Prizes must be taken as offered and cannot be varied. The Prizes cannot be used or redeemed in conjunction with any other offer. The Promoter accepts no responsibility for any variation in Prize value. All Prize values are the recommended retail price including GST.
25. The Promoter’s decision is final in all matters and no correspondences will be entered into, including in the event of a dispute.
26. Costs associated with accessing the Promotional Website remain an Entrant’s responsibility and may vary depending on the Internet service provider used.
27. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all Entries submitted by that Entrant invalid.
28. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
29. If for any reason this Promotion is interfered with in any way or is not capable of running as planned due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right in its discretion, to the fullest extent permitted by law to: (a) modify suspend, terminate or cancel the Promotion as appropriate, subject to approval of the gaming authorities in each State and Territory where relevant; (b) disqualify any Entrant.
30. If the Prize or element of the Prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable Prize or Prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
31. The Promoter has no control over the internet or mobile telephone communications, networks or lines, bugs, viruses and server problems and accepts no responsibility for any problems associated with them, for any reason.
32. The Promoter accepts no responsibility for any tax liability incurred as a result of entering and participating in the Promotion. Any tax liability arising as a result of accepting any Prize is the responsibility of the winner.
33. Purchases of Eligible Products made outside of the Purchase Period or from any other retailer, that is not an Eligible retailer, are not valid for the purposes of the Promotion, unless specified by the Promoter.
34. Selections of Eligible Products are subject to availability at various retailers and are based on reasonably anticipated demand. Eligible Products may not be available for sale in all retailers at all times during the Promotion Period. The Promoter accepts no responsibility for any Eligible Products being unavailable during the Promotion Period.
35. The Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in delivery of Prizes.
36. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Conditions of Entry, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the promotion.
37. The Promoter reserves the right in its discretion to modify the Conditions of Entry.
38. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; © any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of a Prize.
40.
