Terms and conditions of the Metcash Expo WIN 1 of 21 prizes retailer incentive (the “Promotion”)

1) Information on how to enter the Promotion and the prizes form part of these Terms and Conditions. By participating in the Promotion, you accept these Terms and Conditions.

2) The Promoter is Kimberly-Clark Australia Pty Limited, Level 4, 100 Arthur St, North Sydney NSW 2060 (ABN 65 000 032 333).

3) Entry is only open to the nominated representative/owner (aged 18 years or over) of each Metcash affiliated store supplied by Promoter (“Entrant”).

4) To enter this promotion you must do each of the following:

a) order a minimum of 100 cases of any of the nominated products (as set out in item 6) (“Nominated Products”) during the time period from 12.00am AEST 02/06/2023 to 8.00pm AEST 21/07/2023 (“Promotion Period”); and

b) display the Nominated Products in store from 11/09/2023 to 5/11/2023 (“Execution Period”) and take photos of evidence of this during the Execution Period.

The Promoter reserves the right to request proof of photo(s) in accordance with 4(b) before awarding a prize to each winner.

5) When the Entrant orders the Nominated Products and confirmed order qty they be automatically issued a nominated number of tickets in the draw in accordance with the below table (“Entries”).

7) The prize draw will take place at Level 2, 11 York Street, Sydney NSW 2000 at 3pm AEDT on the 13/11/2023. The first twenty one (21) valid entries drawn randomly will win a prize. The total prize pool is $35,000.00.

1^st Prize = 1 x GRAND WINNER = $7,500 Visa Gift Card

2^nd Prize = 5 x MAJOR WINNERS = $2,500 ea Visa Gift Card

3^rd Prize = 15 x MINOR WINNERS = $1,000 ea Visa Gift Card

8) The Promoter reserves the right, at any time, to verify the validity of Entries and to disqualify any Entrant who submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.

9) If any dispute arises between an Entrant and the Promoter concerning the conduct of this competition or claiming a prize, the Promoter will take reasonable steps to consider their point of view, taking into account any facts or evidence they put forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter’s decision is final, and no correspondence will be entered into.

The winners will be notified via phone and email within 2 business days of the draw. The winners details (last name, first initial and postcode) will be published on www.huggies.com.au/iga/retailers/winners on the 20th November 2023. If for any reason a winner does not redeem any part of the prize by the time stipulated by the Promoter, then the prize or that part of the prize will be forfeited. Winners should allow 28 days for prize delivery. The prize must be claimed by 12:00 PM AEDT 27 November 2023. If a prize remains unclaimed an unclaimed prize draw will occur at the same location and time as the original draw on 28 November 2023. Unclaimed prize winner(s) will be notified via phone and email within 2 business days of the draw. The unclaimed prize winners details (last name, first initial and postcode) will be published on https://www.huggies.com.au/iga/retailers/winners on 5th December 2023.

11) The Promoter’s decision on any matter relating to the Promotion is final. If this Promotion is interfered with in any way or is not capable of being conducted for any reason, the Promoter may: (a) disqualify any entrant; or (b) modify, suspend or cancel the Promotion, subject to approval of the relevant authorities.

12) If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.

13) The Promoter and its agents will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize. It is a condition of accepting the prize that the winner agrees to and must comply with all the issuer’s conditions of redemption and use of the prize.
